ORC 153.03 — No Compliance, No Contract.

Ohio law requires every contractor and subcontractor providing labor on state-funded public improvement projects to be enrolled in and in good standing with the BWC's drug-free workplace program — or an approved comparable program — before work begins.

Drug & Alcohol Testing (HHS model)
Employee Education (1 Hour)
Supervisor Training (1+ Hour)

Non-compliance = 5-Year Breach Finding

Failure to maintain enrollment results in a breach of contract that follows your company in the responsibility analysis for all future state contracts for five years.

* Premium bonus eligibility is governed by OAC 4123-17-58 and OAC 4123-17-75. State agencies and self-insuring employers (per ORC 4123.35) are not eligible for SUPR participation. PEO/AEO client employers are eligible only if both the PEO/AEO and all client employers independently meet all program requirements (OAC 4123-17-58(B)(4)). Employers participating in Group Retrospective Rating (OAC 4123-17-73) are eligible for SUPR grant reimbursements but are not eligible for the SUPR premium bonus, as Group Retro provides the maximum allowable discount and precludes stacking of additional premium incentives. Grant reimbursement requires a physical office in Ohio and is available on a first-come, first-served basis while funding remains available (OAC 4123-17-58(J)). Therefore, while reimbursement of eligible expenditures via the SUPR is extremely likely, it cannot be guaranteed.
